How to cancel a lease contract ?

You are a tenant and you want to move, but you do not know where to start. We share our expert advice on how to cancel your lease contract in the best possible way.

How to cancel a lease contract ?

1 Cancellation on due date

First, it is important to know that there are two types of cancellation. Cancellation on the due date and early cancellation.

If you wish to cancel on the due date, all you need to know is the due date written on your contract. However, be aware of the notice period, which in most cases is three months.

For example, if your lease expires on July 1st 2021 and your notice period is three months, you must ensure that your letter of termination reaches your real estate agency before March 31st 2021.

2 Early cancellation

If you want to move quickly, or if your expiry date has just passed, then we recommend early cancellation. By choosing this option, you can cancel your lease with one month’s notice, by the 15th or the end of the following month. However, you should be aware that the notice period does not start as soon as we receive the letter of termination.

This is because in the case of early termination, you are required to provide at least one solvent application from a person willing to take over your lease on the same terms. Your notice period will then begin as soon as we receive a complete and solvent file from a candidate. You should also be aware that you will not be released from your obligations until the lease has been signed by the future tenant.

3 The letter of termination

To be accepted, your letter of cancellation must be sent by post and, for greater security, by registered post. Remember to leave a certain time margin so that you do not miss the deadline.

The most important elements to include in the body of the letter are

  • Contact details of all the leaseholders.
  • Address of the property concerned (flat, parking).
  • The date on which you wish to terminate your lease
  • Signatures of all the leaseholders.

On this last point, be careful to ensure that all the leaseholders sign the document. This rule also applies to guarantors and, in the case of family accommodation; both parties must sign the termination letter, even if they are not both leaseholders.

4 The search for applicants 

If you have opted for early termination, then you will need to start your search. Our experts advise you to send your letter of termination together with a file of a candidate.

This will speed up the process . If you don’t know how to do this, we advise you to post an announcement on social networks. You can also place an ad on websites such as anibis.ch or petitesannonces.ch. So, when you cancel your lease contract, you can expect to be contacted (by e-mail or by phone, depending on your choice) by interested tenants. 

5 Visits

When either you cancel your lease, at the end of the term or in advance, you will be asked to organise visits of your flat in order to facilitate its lease renewal. You can contact our rental department if you wish to organise group visits. In this way, we will stipulate in the advertisement the date and time of the visits according to your instructions.
